New Jersey has adopted responsible-gaming regulations with the force of law that require online gambling operators to identify and address customers who may be at risk of addiction. The state said it is the first in the United States to make data-driven responsible-gaming measures mandatory.
The rules cover internet casinos and mobile sportsbooks, rather than brick-and-mortar casinos. The Division of Gaming Enforcement will oversee compliance, requiring operators to keep records of their reviews, decisions and interventions.
Every operator must designate a responsible-gaming lead and use prescribed patron-play thresholds and behavioural triggers to flag customers who may need support. A trigger alone does not establish that a person has a gambling problem; it starts a due-diligence review of the customer’s gambling activity and behavioural indicators.
If that review finds a customer is at risk, the operator must add the person to its at-risk-patron list. Operators must then follow a three-phase intervention process tailored to the customer’s assessed needs, providing information, encouraging engagement and connecting people with appropriate support.
At the highest level, the responsible-gaming lead must communicate directly with the customer. If the operator still determines that the person is at risk after that intervention, the account must be closed. Operators must also offer assistance resources, including live support where appropriate.
The regulations prohibit operators from sending marketing or promotional material to customers who reach the second or third intervention levels. Failure to comply with the mandatory triggers or intervention process can lead to regulatory discipline, including civil penalties, forfeiture of money or the surrender of profits gained through violations.
According to the state attorney general’s office, the framework is intended to ensure that customers showing signs of problem gambling receive timely and consistent help. Officials said the move was prompted partly by reports that some gambling companies had used aggressive marketing or promotional practices aimed at customers displaying signs of gambling disorders.
The new rules turn what had been similar but uneven and nonbinding responsible-gaming practices into uniform regulatory requirements. They also follow a January 2023 state initiative that required online wagering companies to analyse electronically held player data for warning signs, including large deposits over a short period and repeated requests within 24 hours to raise deposit or loss limits.
That earlier programme also used three escalating responses, from automated outreach to a required responsible-gaming video and, ultimately, direct operator contact. The new regulations formalise a system of review and intervention backed by enforcement powers.
The state is also making the RecoverMe gambling-recovery app available free to New Jersey residents and others located in the state. The app offers cognitive behavioural therapy and mindfulness techniques, validated assessment tools, self-guided therapy and gambling-habit tracking, as well as New Jersey-specific crisis and emergency-support information. It is the Division of Gaming Enforcement’s second free gambling-related support service, after GamFin, a financial-counselling service introduced last year for gambling-related financial harm.
The measures arrive amid broader concern over gambling harms. A 2025 New Jersey task-force report called for expanded addiction services, more education and prominent warning messages in gambling advertising, while the Council on Compulsive Gambling of New Jersey said calls to its 800-GAMBLER helpline had risen 277% since 2018.
Nationally, the National Council on Problem Gambling found that jurisdictions offering legal mobile sports betting met an average of 32 of 82 player-protection standards in an evaluation covering 30 states and the District of Columbia as of June 2024. New Jersey officials said they will continue to evaluate and strengthen safeguards as gambling technology and industry issues evolve.
